Florida's marijuana laws are a bit like a sunburned tourist trying to navigate a swampy maze – confusing and full of unexpected twists. They started off strict, criminalizing possession and sale like it was a rare alligator skin handbag. But then, in a surprising plot twist, they introduced medical marijuana in 2016, leading to a rush of "pot doctors" popping up faster than you can say "Disney World." Now, you can get a medical card for everything from anxiety to a stubbed toe, making Florida the land of palm trees, beaches, and surprisingly relaxed cannabis rules. Just don't forget that even in this sunny paradise, puffing in public can still land you in hot water faster than a flamingo doing the tango.

Generally Florida is not a very progressive state and we would exhibit caution when using Cannabis in Florida. However, the state does get extra bonus points as there is a Medical Marijuana permit granted for numerous conditions.

Florida has a fairly middle-of-the-road Medical Cannabis Program featuring a decent array of dispensaries throughout the state. A Bill currently (06/2023) being presented to state legislature would allow out-of-state cannabis cardholders to make purchases in Florida dispensaries. We hope this is able to pass! Cards cost $75 through the state and there are various services and doctors who will sign allowances for the card. An initial doctors visit is required and needed for annual renewals.

A Qualified Patient Must be:

  1. A permanent or seasonal Florida resident.
  2. Diagnosed with a qualifying medical condition by a qualified physician.
  3. Entered into the Medical Marijuana Use Registry.
  4. Obtain a Medical Marijuana Use Registry Identification Card.

Possessing cannabis
Florida defines cannabis as either low-THC cannabis or medical marijuana. In order to qualify as low-THC, the flowers, seeds, resin, and any other products derived from the cannabis plant must contain 0.8% or less THC and more than 10% CBD by weight.

Patients and caregivers may not possess more than a 70-day supply of cannabis at any given time, and all marijuana purchased must remain in its original packaging. Patients may not purchase more than a 35-day supply of cannabis (2.5 ounces) or possess more than 4 ounces of smokable cannabis at any one time.
Marijuana may not be transferred for any purposes other than a caregiver buying and transporting for a designated patient.
